Please read these Terms carefully before placing an order. By placing an order through our Website, you confirm that you have read, understood, and agree to be bound by these Terms.

These Terms do not affect your statutory rights under the laws of England and Wales.

2. DEFINITIONS
In these Terms:

Account means your registered customer account.

Business Day means Monday to Friday excluding public holidays in England.

Consumer means an individual purchasing goods for personal, domestic or household use.

7. IMPORTED PRODUCTS

Many products sold by Kàkààkí Mart are imported from Africa, the Caribbean and other international markets.

Packaging, labelling and product presentation may differ from products manufactured in the United Kingdom.

Where required by UK legislation, supplementary labels may be applied before sale.

Imported products comply with applicable UK food safety requirements.

8. PRODUCT AVAILABILITY

All products are subject to availability.

Adding items to your basket does not reserve stock.

If an item becomes unavailable after an order is placed, we may:

  • refund the unavailable item;
  • substitute a comparable product (only where you have agreed to substitutions);

We shall not be liable where products become unavailable due to circumstances beyond our reasonable control.

9. PRICING

All prices displayed on our Website are shown in Pounds Sterling (£).

Prices include VAT where applicable.

Delivery charges are calculated separately and displayed during checkout before payment.

Although we make every effort to ensure pricing accuracy, errors may occasionally occur.

Where an obvious pricing error exists, we reserve the right to:

  • cancel the order;
  • refund any payment received;
  • contact you before dispatch to confirm the correct price.

No contract is formed until we have accepted your order.

12. ORDER ACCEPTANCE

At that point a legally binding contract is formed.

13. ORDER CANCELLATION BY US

We reserve the right to refuse or cancel an order before dispatch where:

  • payment cannot be authorised;
  • products become unavailable;
  • pricing errors occur;
  • delivery is not possible;
  • fraudulent activity is suspected;
  • legal or regulatory requirements require cancellation;
  • the order breaches these Terms.

Where payment has already been taken, any refund due will be processed using the original payment method.

14. ACCURACY OF CUSTOMER INFORMATION

You are responsible for ensuring that all information supplied when placing an order is accurate and complete.

This includes:

  • your name;
  • billing address;
  • delivery address;
  • email address;
  • telephone number.

We are not responsible for delays, failed deliveries or additional costs resulting from inaccurate information supplied by you.

15. BUSINESS CUSTOMERS

These Terms apply primarily to consumers.

Where Goods are purchased by businesses, additional Wholesale Terms and Conditions may apply.

Business customers do not benefit from certain consumer rights provided under the Consumer Rights Act 2015.

16. CHANGES TO THESE TERMS

We may amend these Terms from time to time to reflect:

  • improvements to our services;
  • operational changes;
  • new Website features.

17. PAYMENT

We accept payment using the payment methods displayed on our Website at the time of checkout. These may include major debit and credit cards, digital wallets, and other secure payment services.

All payments are processed securely through authorised third-party payment providers. Kàkààkí Mart does not store your full payment card details.

Payment must be successfully authorised before your order can be processed.

If your payment is declined, we will not be obliged to fulfil your order.

18. ORDER CONFIRMATION

Once your payment has been authorised, you will receive an email acknowledging receipt of your order.

This email confirms that we have received your order but does not mean that your order has been accepted.

Your order is accepted only when we send you a Dispatch Confirmation confirming that your goods have been dispatched.

19. DELIVERY AREAS

We currently deliver throughout mainland Great Britain and selected UK postcodes.

Unfortunately, we may be unable to deliver to certain locations including:

  • Northern Ireland (unless specifically offered)
  • The Channel Islands
  • The Isle of Man
  • BFPO addresses
  • International destinations

Delivery availability may change without notice.

20. DELIVERY TIMES

Estimated delivery times are shown during checkout.

Delivery times are estimates only and are not guaranteed.

Although we make every reasonable effort to deliver within the estimated timeframe, delays may occur due to circumstances beyond our reasonable control, including:

  • severe weather;
  • traffic disruption;
  • courier delays;
  • public holidays;
  • industrial action;
  • supplier shortages.

We shall not be liable for losses arising solely from delayed delivery.

21. DELIVERY CHARGES

Delivery charges vary depending on:

  • delivery postcode;
  • delivery method selected;
  • order value;
  • product type (including chilled or frozen goods).

Applicable delivery charges will be clearly displayed before you complete your purchase.

22. DELIVERY OF PERISHABLE GOODS

Fresh, chilled and frozen products require prompt acceptance upon delivery.

You are responsible for ensuring that someone is available to receive the order at the agreed delivery address.

If no one is available:

  • our courier may attempt redelivery;
  • goods may be returned;
  • perishable products may become unsuitable for resale or consumption.

Where delivery fails because nobody was available to receive perishable goods, we may be unable to offer a refund.

23. RISK AND OWNERSHIP

Ownership of goods remains with Kàkààkí Mart until full payment has been received.

Risk in the goods passes to you once they have been delivered to the delivery address specified in your order.

It is your responsibility to inspect your order upon delivery.

24. INSPECTION OF GOODS

You should inspect your order immediately upon delivery.

If you believe:

  • goods are damaged;
  • products are missing;
  • incorrect items have been supplied;
  • products have arrived in an unsatisfactory condition,

please notify us as soon as possible and, where practical, within 48 hours of delivery.

To help us investigate your claim, we may request:

  • photographs of the products;
  • photographs of the packaging;
  • your order number;
  • a description of the issue.

Failure to notify us promptly may affect our ability to investigate your claim.

25. CANCELLATION RIGHTS

Your cancellation rights depend upon the type of goods purchased.

Under the Consumer Contracts Regulations 2013, consumers generally have the right to cancel online purchases within 14 days.

However, this right does not apply to certain categories of goods, including:

  • fresh fruit and vegetables;
  • fresh meat;
  • fresh fish;
  • chilled foods;
  • frozen foods;
  • products liable to deteriorate rapidly;
  • sealed goods which are unsuitable for return due to health protection or hygiene reasons once unsealed.

Where cancellation rights apply, you must notify us clearly before the cancellation period expires.

26. CANCELLING BEFORE DISPATCH

If your order has not yet been prepared for dispatch, you may request cancellation by contacting Customer Services.

We will make every reasonable effort to cancel your order.

However, due to the speed with which food orders are processed, cancellation cannot be guaranteed once order preparation has commenced.

27. RETURNS POLICY

Due to food hygiene legislation and food safety requirements, we cannot normally accept returns of food products unless:

  • goods are faulty;
  • goods are damaged;
  • incorrect goods have been supplied;
  • products are unsafe.

This restriction protects all customers and complies with UK food safety requirements.

28. NON-PERISHABLE GOODS

Where products are not perishable, you may return them within 14 days of delivery provided that:

  • they remain unopened;
  • they are unused;
  • they are in their original packaging;
  • they are suitable for resale.

Unless goods are faulty, customers are responsible for return postage costs.

29. FAULTY GOODS

If goods are faulty, damaged or not as described, you have legal rights under the Consumer Rights Act 2015.

Where appropriate we may:

  • replace the goods;
  • repair the goods (where applicable);
  • issue a full or partial refund.

Nothing in these Terms affects your statutory consumer rights.

30. DAMAGED GOODS

If your order arrives damaged, please contact us as soon as reasonably possible.
Where requested, please provide:

  • photographs of damaged products;
  • photographs of packaging;
  • your order number;
  • details of the damage.

Claims are assessed individually.

31. MISSING ITEMS

If you believe an item is missing from your order, please notify us within 48 hours of delivery.
We will investigate the matter using:

  • dispatch records;
  • courier information.

Where appropriate we may:

  • dispatch the missing item;
  • issue a refund;
  • provide store credit.

32. REFUNDS

Where a refund is approved, it will normally be processed using your original payment method.

Refunds are generally processed within 14 days of approval.

Processing times may vary depending on your payment provider.

33. REFUNDS FOR PERISHABLE PRODUCTS

Refunds for perishable products are considered where:

  • products arrive damaged;
  • products are unsafe;
  • incorrect products are supplied;
  • products are faulty upon delivery.

Refunds will not normally be provided where:

  • products have been stored incorrectly after delivery;
  • products have been consumed;
  • customers simply change their mind.

34. FAILED DELIVERIES

Where delivery cannot be completed because:

  • incorrect delivery details were supplied;
  • nobody was available to receive perishable goods;
  • delivery instructions were inaccurate,

additional delivery charges may apply.

Perishable products that cannot safely be returned to stock may not be eligible for refund.

35. PROMOTIONAL PRODUCTS

Where free promotional products are supplied as part of an offer:

  • no cash alternative is available;
  • promotions remain subject to availability;
  • promotional products cannot be exchanged separately.

If qualifying goods are returned, any associated promotional products may also need to be returned.

36. GIFT CARDS AND VOUCHERS

Where gift cards or promotional vouchers are offered:

  • they may only be redeemed in accordance with their published terms;
  • they cannot normally be exchanged for cash;
  • lost or stolen vouchers may not be replaced unless required by law.

38. FRESH, CHILLED AND FROZEN PRODUCTS

Many of our products are fresh, chilled or frozen and require careful handling to maintain their quality and safety.

Upon delivery, you should promptly:

  • inspect all products;
  • refrigerate chilled goods immediately;
  • freeze frozen products immediately unless they are to be consumed the same day;
  • follow any storage instructions provided on the packaging.

Kàkààkí Mart cannot accept responsibility for any deterioration in product quality caused by delays in refrigeration or freezing after successful delivery.

39. STORAGE AND SHELF LIFE

Customers are responsible for storing products in accordance with the instructions provided on the product packaging.

Best Before and Use By dates are supplied in accordance with UK food legislation.
Customers should:

  • observe Use By dates carefully;
  • consume products before expiry;
  • dispose of products safely once expired.

Kàkààkí Mart shall not be liable for products consumed after their Use By date or stored contrary to the manufacturer's instructions.

Many products sold by Kàkààkí Mart contain, or may have been produced in facilities handling, one or more of the following allergens:

48. LIMITATION OF LIABILITY
